🇩🇪 Peptide Regulations in Germany
Legal Status
Germany follows EU pharmaceutical law (Arzneimittelgesetz — AMG). Peptides intended for therapeutic use require marketing authorization. Research chemicals sold as 'not for human consumption' occupy a grey area — possession is not criminalized, but distribution with therapeutic claims is illegal. The German Customs (Zoll) actively monitors pharmaceutical imports. GLP-1 agonists like semaglutide are prescription-only medicines. Individual states (Bundesländer) may enforce differently.
Compounding Rules
- German pharmacies (Apotheken) may compound patient-specific preparations (Rezepturarzneimittel) on prescription.
- Compounding must follow the German Pharmacopoeia (DAB) and the Pharmacy Operating Regulations (ApBetrO).
- Bulk substance suppliers must hold a manufacturing authorization (Herstellungserlaubnis) under §13 AMG.
- Outsourcing or large-scale compounding requires a full manufacturing license.
Personal Importation
- Individuals may import up to 3 months' supply of prescription medications for personal use when entering Germany.
- Postal imports of prescription drugs from non-EU countries are generally prohibited under §73 AMG.
- Research chemicals labeled 'not for human use' can be imported, but customs may seize substances they deem pharmaceutical.
- Narcotics (BtM) and controlled substances have separate import regulations under the Betäubungsmittelgesetz.
⚠ Key Warnings
- Selling peptides with health claims violates the Heilmittelwerbegesetz (HWG) advertising law for medicinal products.
- German customs (Zoll) is aggressive with pharmaceutical seizures — packages from known peptide sources may be flagged.
- Operating an unlicensed pharmacy or selling prescription drugs carries penalties of up to 3 years imprisonment.
- The Anti-Doping Act (AntiDopG) criminalizes possession of performance-enhancing substances above personal-use thresholds.
How to Verify Legality
- Search BfArM's pharmaceutical database (PharmNet.Bund) at pharmnet-bund.de.
- Check the EU Community Register of medicinal products for centrally authorized medicines.
- Review the German Betäubungsmittelgesetz schedules for controlled substance status.
- Contact BfArM's Scientific Service for regulatory classification queries.
